1. Purpose and acceptance
These Terms of Service (the "Terms") govern access to and use of the Lucy AI mobile application (the "App"), published by Vincent Legardien, a French sole trader ("auto-entrepreneur") registered in France under SIRET number 98377742600013, contact: help.lucyai@proton.me (the "Publisher").
The App offers daily mood tracking and an AI-powered conversational companion named Lucy, designed to provide a personalised wellness experience.
By creating an account or using the App, you (the "User") accept these Terms without reservation. If you do not accept them, you must not use the App. These Terms are accessible at any time from the App settings and at yourfriendlucy.com.
2. Description of the service
Lucy AI lets the User:
- Record their mood daily and view how it evolves over time;
- Freely chat with Lucy, a conversational assistant based on language models, which remembers certain elements of the conversation (preferences, traits, relationships, life events) in order to personalise the conversation over time.
What Lucy is not:Lucy is not a medical device, a telehealth service, or a substitute for professional psychological, psychiatric, or medical care. Lucy's responses are generated by an artificial intelligence system and may be incomplete, inaccurate, or unsuited to an individual situation. The User acknowledges that any decision made on the basis of an exchange with Lucy is their sole responsibility.
3. Transparency about artificial intelligence
In accordance with the EU Artificial Intelligence Act (Regulation (EU) 2024/1689, in particular its Article 50), the Publisher clearly and unambiguously informs the User that:
- Lucy is a conversational artificial intelligence system, not a real person;
- Lucy's responses are generated automatically by language models supplied by a third-party provider (currently OpenAI), based on the User's messages and a personalisation profile built up over the course of the conversation;
- if the Publisher develops its own artificial intelligence system to power Lucy in the future, this notice will be updated accordingly.
4. Conditions of access
4.1 Minimum age
Use of the App is restricted to persons aged 18 or older, regardless of their country of residence. By creating an account, the User declares and warrants that they have reached this age. The Publisher reserves the right to suspend or delete any account it becomes aware of that does not meet this condition.
4.2 User account
- The account is strictly personal and may not be shared, transferred, or used by a third party;
- the User agrees to provide accurate information and keep it up to date;
- the User is responsible for the confidentiality of their login credentials and for any activity carried out from their account;
- the User must promptly inform the Publisher of any unauthorised use of their account, at help.lucyai@proton.me.
5. Subscription and pricing
5.1 Business model
Access to the App's features requires a paid subscription (monthly or annual, at the User's choice), preceded by a free trial period. The User may cancel the trial at any time before it ends to avoid being charged; absent cancellation, the paid subscription starts automatically at the end of the trial period.
5.2 Payment and renewal
Payments are handled exclusively by the Apple App Store or Google Play, depending on the User's operating system. The Publisher never receives or stores any payment card data. The subscription renews automatically at each billing period (monthly or annual), unless cancelled by the User before the renewal date, within the timeframe required by the platform used (Apple App Store or Google Play), directly from their Apple or Google account settings.
5.3 Cancellation and refunds
Subscription management, cancellations, and refund requests are governed by the terms and refund policies specific to the Apple App Store and Google Play, accessible from the User's Apple or Google account settings respectively. The Publisher can neither initiate nor guarantee a refund issued by these platforms.
5.4 Right of withdrawal
Under Article L. 221-28 13° of the French Consumer Code, the standard 14-day right of withdrawal does not apply to the supply of digital content not provided on a physical medium once performance has begun with the consumer's prior express agreement and express waiver of the right of withdrawal. By confirming the purchase through Apple's or Google's native payment screen at the end of the free trial, the User gives this express agreement and waives their right of withdrawal as of the start of the paid subscription. The User may cancel their subscription for the future at any time, without retroactive effect on amounts already due.
6. Intellectual property
6.1 App content
The App, its name, logo, interface, text, visual identity, and Lucy's character are the exclusive property of the Publisher or its licensors and are protected by intellectual property law. Nothing in these Terms grants the User any right to reproduce, represent, or exploit these elements.
6.2 User content
The User retains ownership of the messages they write (the "User Content"). By using the App, the User grants the Publisher a non-exclusive, worldwide, royalty-free licence to use, store, process, and display User Content to the extent necessary to:
- provide and operate the Lucy AI service;
- maintain, improve, and develop the Lucy AI service, including, where applicable, to train or fine-tune the Publisher's own artificial intelligence models intended to power Lucy.
The Publisher commits to never selling User Content to third parties. If the Publisher were to wish to use User Content in the future for a purpose materially different from improving the Lucy AI service, it commits to informing the affected Users beforehand and obtaining their explicit consent before any such use, in accordance with applicable personal data protection law.
7. Emotional distress situations
Lucy is designed to respond with care if the User expresses significant emotional distress, but she is not an emergency service, is not designed to assess life-threatening risk, and cannot intervene physically. Lucy must never be used as the sole resource in a crisis: the User acknowledges that they must not rely on Lucy for crisis intervention and that it is their responsibility to seek qualified human help in case of distress. In the event of immediate danger to yourself or others, contact your country's emergency services without delay. For reference:

These numbers are provided for information only and may change; the Publisher makes reasonable efforts to keep them up to date but does not guarantee their permanent accuracy.
8. User obligations
The User agrees not to, in connection with their use of the App:
- post or transmit unlawful, abusive, defamatory, hateful content, or content infringing a third party's rights;
- attempt to circumvent the safety rules or operating limits of the artificial intelligence built into the App;
- use the App for unauthorised commercial purposes, or to harass, impersonate a third party, or harm others;
- engage in reverse engineering, automated data extraction (scraping), or any attempt at unauthorised access to the Publisher's systems;
- use the App in violation of the laws applicable in their country of residence.
In the event of a breach of these obligations, the Publisher reserves the right, at its discretion and, in serious cases, without prior notice, to temporarily or permanently suspend access to the account of the User concerned, without prejudice to any other legal action available to the Publisher.
9. Service availability
The Publisher strives to ensure continuous access to the App but does not guarantee uninterrupted availability. The App is provided "as is" and "as available". Interruptions may occur for maintenance, updates, or due to circumstances beyond the Publisher's reasonable control (a technical provider's outage, force majeure), without the Publisher's liability being engaged on that basis.
10. Limitation of liability
To the extent permitted by applicable law, the Publisher's liability may only be engaged where fault is proven, and will, except as set out below, be limited to direct and foreseeable damages. In particular, the Publisher cannot be held liable for indirect damages, data loss, or harm resulting from a decision made by the User on the basis of an exchange with Lucy, provided no fault of the Publisher is established.
In accordance with Article R. 212-1 of the French Consumer Code and Article 1170 of the French Civil Code, nothing in these Terms excludes or limits, or may be interpreted as excluding or limiting, the Publisher's liability for death or personal injury resulting from the Publisher's proven fault, or for gross negligence or wilful misconduct. This limitation of liability does not relieve the User of their obligation to seek qualified human help in case of distress, in accordance with Section 7.
11. Personal data
The processing of the User's personal data in connection with use of the App is described in the Privacy Policy, which forms an integral part of these Terms. In the event of a conflict between the two documents on a matter relating to personal data, the Privacy Policy prevails.
12. Term and termination
These Terms apply for as long as the User uses the App. The User may stop using the App and/or delete their account at any time from the settings, which triggers deletion of their data in accordance with the Privacy Policy. Termination of a paid subscription follows the terms described in Section 5.
The Publisher also reserves the right to permanently discontinue operation of the App, in particular for economic or technical reasons. In that case, Users will be given reasonable notice within the App, and any ongoing paid subscription will be terminated effective the date the service is discontinued, without prejudice to any refund arrangements that may apply under the rules of the payment platform used (Apple App Store or Google Play).
13. Changes to these Terms
The Publisher may amend these Terms, in particular to reflect changes to the service, the applicable law, or pricing. Any substantial change will be notified to the User within the App, with reasonable notice before it takes effect. Continued use of the App after that notice period constitutes acceptance of the amended Terms; absent acceptance, the User may terminate their account before the new Terms take effect.
14. Complaints
For any question or complaint, the User may contact the Publisher at help.lucyai@proton.me. The Publisher commits to responding within a reasonable timeframe.
15. Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and after an attempt at amicable resolution, the competent French courts shall have exclusive jurisdiction, subject to the mandatory consumer-protection rules applicable at the User's place of residence where the User resides in another Member State of the European Union.
16. Miscellaneous
- Reference language: these Terms are originally drafted in English, which is the reference version. A French version is also provided to meet French language requirements applicable to consumers residing in France. In the event of a discrepancy in interpretation, the English version prevails, except for the mandatory consumer protection provisions applicable to Users residing in France, which remain applicable regardless of contract language.
- Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Publisher regarding use of the App.
- Severability: if any clause of these Terms is found invalid or unenforceable, the remaining clauses shall remain fully applicable.
- No waiver:the Publisher's failure to enforce any provision of these Terms at any given time shall not be construed as a waiver of its right to enforce that provision later.
